Cancellation, Rules & Regulations Policy
Pirates on the Manasquan Events
Private Parties: A Cancellation fee equal to the Event Cost Schedule below will be charged for any cancellation that is made less than seven days before the scheduled event. Pirates on the Manasquan LLC. is not responsible for passengers that miss boarding and/or delayed or any other incident that results in failure to comply with the required cancellation policy.
EVENT COST SCHEDULE:
Day(s) before Event Launch: (after 3PM, the next daily Event Cost is calculated)
6-5 days before Event = 25% Event Cost
5-4 days before Event = 50% Event Cost
4-3 Days before Event = 75% Event Cost
2-1 Days before Event = 90% Event Cost
Individual Ticket Purchase: A Cancellation fee equal to the total event cost will be charged for any cancellation that is made less than 48 hours before the scheduled event. Pirates on the Manasquan LLC. is not responsible for passengers that miss boarding and/or delayed or any other incident that results in failure to comply with the required cancellation policy.
I understand and agree to pay the entire contract or ticketed price if cancellation policy is not followed.
No-Show Policy
A no show fee equal to the total event cost which will be charged when the client(s) fails to show at the designated location for which a reservation has been made.
Deposit Policy
A deposit of 25% is required on reservations for private events. The deposit is refundable if the event is cancelled at least seven days prior to the event.
Payment Procedures
Cash or Credit Card (American Express, Visa, Master Card, and Discover) is the standard accepted and agreed upon payment method. Charges will reflect costs associated with the booking placed with Pirates on the Manasquan LLC. by the client.
Booking Method
Reservations may be booked 24 hours a day, 7 days a week, and 365 days a year via email. Reservations, changes or cancellations may be made by calling our phone number. Reservations are accepted up to 24 hours in advance. Less than 24-hour notice is subject to availability. It is suggested that the client provides Pirates on the Manasquan LLC. with a primary contact phone number once the booking is complete.
Special Circumstances
In the event, any client's behavior places themselves, other guests, the Crew, the Captain or the vessel at risk for harm, the Captain and/or Crew may require a client/guest to exit the vessel. Refunds will be offered at the discretion of the Pirates on the Manasquan LLC.
Client's obligations: I understand and agree to the charges related to the event/experience and further agree to pay for any and all damages the client or guest may cause during the event period. I also agree to the above Pirates on the Manasquan LLC. Rules and Regulations. All damages are the sole discretion of the Captain.
Indemnification and Hold Harmless
Pirates on the Manasquan and Client each agree to defend, indemnify, and hold harmless the other party from and against all claims, actions or causes of action, liabilities, including reasonable attorneys' fees, and costs arising from the defense of any claim, action, cause of action or liabilities arising out of or resulting from any act taken or committed by Pirates on the Manasquan LLC. or Client pursuant to the performance of each party's obligations hereunder. Pirates on the Manasquan LLC. and Client each agree to defend, indemnify, and hold harmless the other party for any claim, action, cause of action, and liabilities which may be asserted by third parties arising out of the performance of either party's obligations pursuant to this contract, except for the willful misconduct or gross negligence of the other party.
Insurance
Pirates on the Manasquan LLC. shall obtain and maintain and provide evidence of insurance upon request in amounts sufficient to provide coverage for any liabilities arising out of or resulting from the respective obligations pursuant to this agreement.
Dispute Resolution
If there is a dispute concerning the quality of service and / or any incidents thereto, the parties agree that they shall resolve such dispute by good faith negotiation or common law binding arbitration.
Waiver
If one party agrees to waive its right to enforce any term of this agreement, it does not waive its right to enforce such term or any or all other terms of this agreement at any other time. Pirates on the Manasquan LLC does not guarantee arrival at or departure from any point at a specific time due to circumstances beyond its control and shall not be held liable for claims resulting in delays from such conditions. Customer waives all claims for consequential damages and agrees that liability shall be limited to the costs accrued to Pirates on the Manasquan LLC. for the disputed service.
Governing Law
This agreement shall be governed by and construed under the laws of the New Jersey. If any provision of the contract is unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
Attorneys' Fees
In the event any legal action is taken by either party against the other party to enforce any of the terms and conditions of this agreement, it is agreed that the unsuccessful party to such action shall pay to the prevailing party therein all court costs, reasonable attorneys' fees, and expenses.
Acceptance
If agreement as stated above meets with the approval of Client, it will be considered accepted in its entirety unless written notice is received within 5 days by Pirates on the Manasquan LLC.
